The CBI has filed its first chargesheet in the case involving the rape and murder of a junior doctor at R G Kar Medical College and Hospital, naming Sanjay Roy, a civic volunteer with Kolkata Police, as the primary accused.
The junior doctor’s body was discovered on August 9 in the seminar room of the hospital’s emergency building, where she had reportedly been resting during her night shift, according to the chargesheet.
The incident sparked widespread outrage and prompted a prolonged strike by doctors across West Bengal. Roy, a civic volunteer assigned to the police outpost at the hospital, was arrested shortly after the incident, and the investigation was later transferred to the CBI.
On Monday, 58 days after the tragic rape and murder of the junior doctor, the CBI submitted a 45-page chargesheet to the Additional Chief Judicial Magistrate’s court in Sealdah, identifying Sanjay Roy as the sole perpetrator of the crime. Sources within the CBI noted that the chargesheet did not indicate any evidence of gang rape, despite earlier allegations suggesting the involvement of others. The document emphasizes that the investigation has so far uncovered only Roy’s direct participation in the horrific act.
A CBI source revealed that “Sanjay Roy has been charged with rape and murder. There is no mention of gang rape in the chargesheet. He is the sole accused in this case. However, the investigation is ongoing. It was noted that he was intoxicated at the time of the crime, as stated in the chargesheet.”
The chargesheet also details that CCTV footage captured Roy entering the seminar room where the doctor was resting around 4 AM on August 9 and exiting approximately 30 minutes later. Additionally, forensic evidence showed that the blood and tissue found under the victim’s nails matched Roy’s DNA.
The CBI has included the forensic and DNA reports as part of the chargesheet.
The chargesheet revealed that the doctor suffered 16 external injuries and nine internal injuries. It also noted that Sanjay Roy attempted to mislead investigators during questioning.
According to CBI sources, Roy has been charged under several sections of the BNS, including Section 64 (rape), Section 66 (causing death or resulting in a persistent vegetative state), and Section 103(1) (murder). A source indicated that the penalty for Section 66 includes rigorous imprisonment of no less than 20 years, which can extend to life imprisonment or even the death penalty. Meanwhile, Section 103(1) carries a punishment of death or life imprisonment.
